Welcome to Link Ling! This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you ("User" or "you") and Link Ling, LLC ("Company", "we", "our", or "us"). By downloading, installing, or using Link Ling ("App"), you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not download, install, or use the App.

1. Scope of License

1.1 License Grant

Subject to your compliance with this Agreement, we grant you a non-exclusive, non-transferable, revocable license to install and use the App on a mobile device that you own or control, for personal and non-commercial use.

1.2 Restrictions

• You may not distribute or make the App available over a network where it could be used by multiple devices simultaneously.

• You may not rent, lease, lend, sell, redistribute, or sublicense the App.

• You may not copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App or any part thereof, except as permitted by applicable law.

1.3 App Upgrades

Any upgrades provided by us that replace or supplement the original App are subject to this EULA unless accompanied by a separate license agreement.

2. Consent to Use of Data

2.1 Data Collection

You agree that we may collect and use technical data and related information, including but not limited to technical information about your device, system, and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support, and other services to you related to the App.

2.2 Data Use

We may use this information, as long as it is in a form that does not personally identify you, to improve our products, services, or technologies.

2.3 Advertising

The App uses Google AdMob to serve advertisements. By using the App, you understand and agree that AdMob may serve ads that are relevant to you. Ads may be targeted based on your location, device, or user behavior. Google may collect and process certain information about your device and use this data to provide targeted advertisements.

3. Termination

3.1 Termination by You

You may terminate this Agreement by deleting the App and all copies thereof from your device.

3.2 Termination by Us

We may terminate this Agreement at any time if you fail to comply with any term(s) of this Agreement. Upon termination, you must cease all use of the App and delete all copies of the App from your device.

4. External Services

4.1 Access

The App may enable access to third-party services and websites ("External Services"). Your use of the External Services is at your sole risk.

4.2 No Liability

We are not responsible for examining or evaluating the content or accuracy of any third-party External Services, and we will not be liable for any such third-party services.

4.3 Compliance

You agree to use the External Services in accordance with applicable laws and not to infringe any intellectual property rights of the third party or us.

5. User-Generated Content

As a user of the app, you may have the opportunity to create, share, and post content, including but not limited to text, images, audio, and video (“User-Generated Content”). By submitting User-Generated Content, you agree to the following terms:

5.1 Responsibility

You are solely responsible for the content you post or transmit through the App.

5.2 Content Rights

By posting or transmitting content through the App, you grant us a non-exclusive, worldwide, royalty-free license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform, and publicly display such content in connection with the App.

5.3 Prohibited Content

You are strictly prohibited from submitting or sharing any User-Generated Content that:

• Violates any local, state, national, or international law or regulation.

• Is abusive, threatening, harmful, defamatory, obscene, or otherwise offensive.

• Promotes discrimination, hatred, or violence based on race, gender, religion, nationality, disability, sexual orientation, or age.

• Contains sexually explicit or pornographic material.

• Includes harassment, bullying, or incitement to violence or harm.

• Violates the privacy rights of any person by sharing personal information, such as addresses, phone numbers, or other identifying details without their consent.

• Promotes illegal or harmful activities, such as drug abuse or violence.

• Contains viruses, malware, or any other harmful code.

• Spreads false or misleading information, including but not limited to impersonating others or providing unsolicited investment advice.

• Solicits or offers investments in unregulated or unregistered securities.

• Engages in deceptive practices, such as making false promises or misrepresenting the purpose of a request for money.

• Coerces or manipulates others into sending money.

• Infringes on intellectual property rights, such as copyrights or trademarks.

• Sends unsolicited commercial messages or spam.

• Scrapes or harvests data from the platform without authorization.

• Disrupts the platform's functionality or other users' experiences.

• Violates the platform's terms of service or community guidelines.

5.4 Moderation

We reserve the right, but are not obligated, to monitor, review, and remove any User-Generated Content that we determine, in our sole discretion, to violate these Terms of Use or any applicable law. We may also take appropriate action against the user responsible for such content, including suspending or terminating access to the app.

5.5 Reporting Violations

If you encounter any User-Generated Content that violates these Terms, please report it to us immediately. We will investigate and take action as necessary, but we are not responsible for moderating all content at all times.

5.6 User Responsibility

You are solely responsible for the User-Generated Content you create, share, or post. By submitting content, you warrant that you own or have the necessary rights and permissions to use and distribute such content.

6. NO WARRANTY

6.1 Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6.2 Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• (A) YOUR USE OF THE APP;

• (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP;

• (C) ANY CONTENT OBTAINED FROM THE APP;

• (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

7. Export Restrictions

7.1 Compliance

You may not use or otherwise export or re-export the App except as authorized by the laws of the jurisdiction in which the App was obtained. In particular, the App may not be exported or re-exported to any countries subject to export control sanctions.

8. Governing Law and Dispute Resolution

8.1 Governing Law

This Agreement shall be governed by the laws of the jurisdiction where the Company is headquartered, excluding its conflicts of law provisions.

8.2 Dispute Resolution

Any disputes arising out of or relating to this Agreement will be resolved through binding arbitration or in the courts of the jurisdiction where the Company is headquartered, depending on your location and applicable laws.

9. General Provisions

9.1 Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

9.2 Entire Agreement

This Agreement constitutes the entire agreement between you and us regarding the use of the App and supersedes any prior agreements or understandings.
